La decisión de la jueza se dio a conocer el viernes por la noche

La presentación pedía al gobierno porteño que defienda su autonomía ante el DNU de Alberto Fernández

Fue por decisión de la magistrada Romina Tesone quién rechazó un amparo para volver a las clases presenciales. La decisión de la jueza se dio a conocer el viernes por la noche y rechazó in límine la cautelar de un grupo de madres y padres a través de la Defensoría Oficial y Asesoría Tutelar para que haya clases presenciales y se declare la inconstitucionalidad del DNU 241/2021 firmado por el presidente.

El concepto de rechazo in límine de una demanda significa que el reclamo no reviste fundabilidad o carece de un interés tutelado por el ordenamiento, tiene como fundamento evitar un inútil dispendio de la función jurisdiccional. La ley procesal contempla el rechazo in limine de las demandas que no se ajustan a las reglas formales que el propio ordenamiento adjetivo prescribe.

Por ahora y a pesar de las intenciones del gobierno de la ciudad las clases serán virtuales hasta los primeros días de mayo.

La presentación había sido patrocinada por la defensora oficial María Lorenz González Castro Feijóo y la asesora tutelar Norma Beatriz Sas, en la justicia en lo contencioso administrativo de la ciudad de Buenos Aires en la que pidieron una medida cautelar en la que “se declare la suspensión de los efectos del DNU 241/2021″. Pero la resolución judicial no accedió a sus requerimientos.

Si bien no se pudo conocer el fallo completo con los considerandos que tomó la magistrada, se conocieron las decisiones adoptadas por Tesone. “Rechazar in límine el amparo incoado con relación a la pretensión consistente en que ordene al Gobierno local defender la Autonomía de la Ciudad”, detalló en el primer punto de su decisión. Los antecedentes de la jueza son repartidos con decisiones en favor y en contra del gobierno porteño.

“Declararme incompetente para conocer en torno al pedido de declaración de inconstitucionalidad del Decreto de Necesidad y Urgencia 241/PEN72021”, señala el segundo punto. La jueza se declaró incompetente dado que la justicia porteña no puede decidir sobre la constitucionalidad de un decreto presidencial que a su vez la procuradora ya decidió que es competencia de la Corte Suprema de Justicia.

Por último, la decisión de la jueza sostiene: “Rechazar, en atención a la forma en que se resuelve, los pedidos de habilitación de días y horas inhábiles efectuados por el frente actor y el por gobierno de la ciudad de Buenos Aires”. De esta manera el primer intento por frenar la suspensión de clases presenciales quedó trunco, aunque son muchos más los amparos presentados y el mismo grupo de padres podrá apelar la resolución de Tesone.
